The process typically takes 18–24 months for a straightforward application. After filing, you receive a TM acknowledgement immediately, which already provides interim protection. The examination, journal publication, and opposition period together account for the remaining time. Applications with objections or oppositions may take longer.
The official government fee is ₹4,500 per class for individuals, startups, and small enterprises, and ₹9,000 per class for others. These fees are paid directly to the Indian Trademark Registry and are separate from tmzon's service charges shown above.
You need to register in every class that covers your goods or services. For example, a fashion brand selling clothing (Class 25) that also runs an online store (Class 35) should register in both. The Trademark Examiner may raise objections if they believe your mark is descriptive, similar to an existing mark, or lacking distinctiveness. You have 30 days to file a response.
You can use the ™ symbol immediately after filing your application — it signals that you are claiming trademark rights. The ® symbol can only be used once your trademark is officially registered by the Indian Trademark Registry. Using ® before registration is a legal offence in India.
A registered Indian trademark is valid for 10 years from the date of application. It can be renewed indefinitely for further periods of 10 years each. Timely renewal is important — failure to renew can result in your mark being removed from the register.
Yes. A trademark registered under the Indian Trade Marks Act is protected throughout the entire territory of India. For international protection, you would need to file separate applications in each country or use the Madrid Protocol system for international trademark registration.
